# Partner visa (offshore) (subclass 309) for applicants from India

The subclasses 309 and 100 are the two-stage partner visa for spouses and de facto partners who apply from outside Australia. The 309 is temporary; the 100 is permanent and is usually assessed about two years after the original application.

## For Indian applicants
Most Indian partner applications are spouses of Australian citizens or permanent residents, often after an arranged marriage with a short cohabitation history. The department tests a genuine and continuing relationship on four pillars: finances, household, social recognition and commitment. Evidence that is thin on any pillar is the usual reason for delay or refusal.

## Eligibility
- Married to, or in a registered or de facto relationship with, an Australian citizen, permanent resident or eligible New Zealand citizen
- The relationship is genuine and continuing, and you live together or do not live apart permanently
- Sponsor is approved and has not sponsored more than two partners in their lifetime, with five years between sponsorships
- Health and character requirements for the applicant; character checks for the sponsor

- Marriage certificate or de facto registration, wedding photos and event evidence
- Joint financial evidence: accounts, transfers, insurance, property
- Household evidence: shared address, bills, correspondence
- Social evidence: Form 888 statements from Australian friends and relatives, travel together, family events
- Communication records showing the relationship over time
- Sponsor's citizenship or PR evidence, police checks and income details

You can apply for a visitor visa, but you must be outside Australia when the 309 is decided. We plan the travel around that rule.
